8/18/05

To our valued customer:

We at Applied Concepts Inc. are committed to the same environmental concerns as the rest of the world and support the initiative(s) presented by the following:

  1. RoHS – European Union (EU) Directive on the Restriction of certain Hazardous Substances

  2. WEEE – Waste from Electrical and Electronic Equipment

  3. The Electronic Waste Recycling Act of 2003 (California)

We draw to your attention to the section(s) of these Directive’s whereby the articles define electrical and electronic equipment subject to the Directive as “equipment designed for use with a voltage rating not exceeding 1000 volts for alternating current and 1500 volts for direct current”. All ACI Inverters marketed and produced generate voltage levels in excess of 1000 volts AC. Working with such voltage levels requires our products to operate on a stable platform, one that exhibits high solder-joint integrity and is flame retardant. Because of this fact, we have made the decision not to completely switch over to all RoHS compliant components at this time. This decision in no way jeopardizes your ability to use ACI products and be RoHS/WEEE compliant since products generating these higher voltage levels are not within the scope of these directives.

The following are excerpts from the aforementioned directives:

  1. Directive 2002/95/EC of the European Parliament and of the Council of 27 January 2003, Article 3, section (a), which states:

    ‘electrical and electronic equipment’ or ‘EEE’ means equipment which is dependent on electric currents or electromagnetic fields in order to work properly and equipment for the generation, transfer and measurement of such currents and fields falling under the categories set out in Annex IA to Directive 2002/96/EC (WEEE) and designed for use with a voltage rating not exceeding 1,000 volts for alternating current and 1,500 volts for direct current;

  2. Part III – Draft WEEE guidance, Annex B ‘decision tree’

    1st Level Decision:

    Less than 1,000v AC or 1,500v DC?

    Yes = Fits within one of 10 product categories?

    No = Not covered

  3. California’s Senate Bill No. 50, Chapter 863, Section 1, paragraph (e)

    In adopting regulations pursuant to this section, the department may not require the manufacture or sale of an electronic device that is different than, or otherwise not prohibited by, the European Union under Directive 2002/94/EC, adopted by the European Parliament and the Council of the European Union on January 27, 2003.

Applied Concepts will continue to “design-in” RoHS/WEEE compliant components, as they are deemed safe & reliable alternatives. We will keep our valued customer informed of our progress in this effort.

Sincerely,

Stephen C. Soos

President – Applied Concepts Inc.
